Terms of Service

1. Introduction

Welcome to InfanFute English Academy ("we," "our," or "us"). These Terms of Service ("Terms") govern your use of our website, educational services, and related offerings. By accessing our website or enrolling in our courses, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use our services.

2. About Our Services

InfanFute English Academy provides English language education services, including:

  • General English courses
  • Business English programs
  • IELTS preparation courses
  • One-on-one tutoring services
  • Conversation classes
  • Online learning platforms
  • Educational resources and materials

3. Eligibility and Registration

3.1 Age Requirements

You must be at least 16 years old to enroll in our courses independently. Students under 18 require parental or guardian consent for enrollment.

3.2 Accurate Information

When registering, you agree to provide accurate, current, and complete information. You are responsible for maintaining the accuracy of your account information.

3.3 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Course Enrollment and Fees

4.1 Course Enrollment

Enrollment in courses is subject to availability and our assessment of your English proficiency level. We reserve the right to refuse enrollment or recommend alternative courses based on your assessment results.

4.2 Fees and Payment

  • Course fees are payable in advance as specified in your enrollment agreement
  • Payment can be made by cash, bank transfer, credit card, or other accepted methods
  • All fees are in Australian Dollars (AUD) unless otherwise specified
  • Fees are subject to change with reasonable notice

4.3 Refund Policy

  • Full refund: Available if cancellation occurs at least 7 days before course commencement
  • Partial refund: 50% refund available if cancellation occurs 2-6 days before course commencement
  • No refund: No refund available for cancellations less than 48 hours before course start or after course commencement
  • Medical circumstances: Special consideration may be given for documented medical emergencies
  • Course cancellation by us: Full refund provided if we cancel a course

5. Student Responsibilities

5.1 Attendance

Regular attendance is essential for course success. Students are expected to attend at least 80% of scheduled classes. Poor attendance may result in course dismissal without refund.

5.2 Behavior and Conduct

Students must:

  • Treat staff and fellow students with respect
  • Arrive punctually for classes
  • Complete assignments and homework as required
  • Follow academy policies and procedures
  • Maintain appropriate behavior in all academy facilities

5.3 Academic Integrity

Students must maintain academic honesty and integrity. Plagiarism, cheating, or other forms of academic misconduct may result in course dismissal.

6. Our Responsibilities

6.1 Quality Education

We are committed to providing high-quality English language education delivered by qualified and experienced instructors.

6.2 Safe Learning Environment

We strive to maintain a safe, supportive, and inclusive learning environment for all students.

6.3 Course Materials

We will provide necessary course materials and resources as outlined in your course description.

We will monitor your academic progress and provide feedback to help you achieve your learning goals.

7. Intellectual Property

7.1 Our Content

All course materials, teaching resources, website content, logos, and trademarks are owned by InfanFute English Academy or our licensors. You may not reproduce, distribute, or create derivative works without our written permission.

7.2 Student Work

You retain ownership of your original work created during courses. However, you grant us permission to use your work for educational and promotional purposes.

8. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which forms part of these Terms.

9. Limitation of Liability

9.1 Service Limitations

While we strive to provide excellent education, we cannot guarantee specific learning outcomes or test scores. Individual results depend on various factors including student effort, attendance, and aptitude.

9.2 Liability Limits

To the maximum extent permitted by law, our liability is limited to the fees paid for the specific course or service in question. We are not liable for indirect, consequential, or incidental damages.

9.3 Force Majeure

We are not liable for delays or failures in performance due to circumstances beyond our reasonable control, including natural disasters, government actions, or public health emergencies.

10. Course Changes and Cancellations

10.1 Schedule Changes

We may need to change course schedules, instructors, or locations due to unforeseen circumstances. We will provide reasonable notice of such changes.

10.2 Course Cancellation by Academy

We reserve the right to cancel courses due to insufficient enrollment or other operational reasons. In such cases, students will receive a full refund or be offered alternative courses.

11. Disciplinary Actions

We reserve the right to take disciplinary action, including course dismissal, for:

  • Violation of academy policies
  • Disruptive or inappropriate behavior
  • Academic misconduct
  • Non-payment of fees
  • Harassment of staff or other students

Disciplinary actions may be taken without refund of fees paid.

12. Technology and Online Services

12.1 Technical Requirements

For online courses, you are responsible for ensuring you have appropriate technology and internet connectivity.

12.2 Technical Issues

We will make reasonable efforts to ensure our online platforms function properly, but we are not liable for technical issues beyond our control.

12.3 Platform Rules

When using our online platforms, you agree to:

  • Use the platform only for educational purposes
  • Not share login credentials
  • Not attempt to circumvent security measures
  • Respect intellectual property rights

13. Complaints and Disputes

13.1 Internal Resolution

We encourage students to raise concerns directly with us. We have internal procedures for handling complaints and will work to resolve issues promptly and fairly.

13.2 External Resolution

If internal resolution is unsuccessful, disputes may be referred to relevant consumer protection agencies or alternative dispute resolution services.

13.3 Governing Law

These Terms are governed by the laws of Queensland, Australia. Any legal proceedings must be conducted in the appropriate courts of Queensland.

By enrolling in our services, you consent to receive communications from us via:

  • SMS/text messages
  • Phone calls
  • Postal mail
  • Our online platforms

You may opt out of non-essential communications at any time.

15. Termination

15.1 Termination by Student

You may terminate your enrollment subject to our refund policy outlined in Section 4.3.

15.2 Termination by Academy

We may terminate your enrollment for breach of these Terms, non-payment, or other reasonable cause. Termination for cause will be without refund.

16. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated to current students via email or posted prominently on our website. Continued use of our services after changes constitutes acceptance of the new Terms.

17. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any guarantee, warranty, term, condition, or right that cannot be excluded under Australian Consumer Law or other applicable legislation.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable.
